Agreement

These Terms of Use are an agreement between you and Jayde Design. By accessing or using https://www.jaydedesign.studio, submitting a strategy-call request, or contacting Jayde Design through the website, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the website.

These Terms apply only to the public website and related inquiry flow. Paid project work, retainers, automation implementation, AI-agent implementation, data processing, and managed services should be covered by a separate written proposal, statement of work, master services agreement, data processing agreement, or similar client contract. If a separate written agreement conflicts with these Terms, that written agreement controls for the covered work.

Website And Service Information

Jayde Design describes services related to websites, lead generation websites, lead automation systems, AI agents, CRM handoffs, analytics, dashboards, booking paths, follow-up workflows, and related digital growth systems. The website is informational and is meant to help business visitors understand potential services and request a free strategy call.

A strategy call is an introductory business conversation. It does not create a client relationship, agency relationship, fiduciary duty, exclusivity, professional advisory relationship, or obligation to perform paid work unless Jayde Design and you both sign or otherwise accept a separate written agreement.

Acceptable Use

You agree not to:

• Use the website for illegal, deceptive, harmful, abusive, or infringing activity.
• Submit malware, spam, automated scraping, abusive traffic, or attempts to disrupt the website.
• Misrepresent your identity, business, authority, or relationship with Jayde Design.

AI And Automation Boundaries

The website describes possible AI-assisted intake, calling, texting, email, summaries, routing, and escalation workflows. Any future AI or automation implementation should be governed by a separate written agreement that defines approved channels, consent requirements, escalation rules, human review, transcript handling, provider terms, and data processing responsibilities.

Automated or AI-generated output may be inaccurate, incomplete, delayed, or unsuitable for a specific situation. Businesses should keep human review and control over sensitive, urgent, regulated, or high-value decisions.

Limitation Of Liability

To the fullest extent permitted by law, Jayde Design and its owners, team members, contractors, agents, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, loss of goodwill, business interruption, or missed opportunities arising from or related to the website, these Terms, third-party services, or website communications.

To the fullest extent permitted by law, Jayde Design's total liability for claims arising from or related to the website or these Terms will not exceed the greater of the amount you paid Jayde Design for website access in the 12 months before the claim or one hundred US dollars ($100). Because website access is currently free, this cap will usually be $100.

Some jurisdictions do not allow certain exclusions or limitations. In those jurisdictions, the limitations above apply to the greatest extent permitted by law. Nothing in these Terms limits rights that cannot be limited under applicable consumer protection law.

Indemnification

You agree to defend, indemnify, and hold harmless Jayde Design and its owners, team members, contractors, agents, and service providers from claims, liabilities, damages, losses, costs, and expenses, including reasonable legal fees, arising from your use of the website, information you submit, your violation of these Terms, your violation of law, or your violation of third-party rights.

Disputes

Before starting a formal dispute, you agree to contact Jayde Design at jawad@jaydedesign.studio and attempt to resolve the issue informally. Jayde Design will try to respond within a reasonable time.

Disputes related to the website or these Terms must be handled on an individual basis and not as a class, consolidated, or representative action. Nothing in these Terms prevents either party from seeking urgent injunctive or equitable relief where legally available.

To the fullest extent permitted by law, any claim related to the website or these Terms must be brought within one year after the claim arises, or the claim is permanently barred.

Changes To These Terms

Jayde Design may update these Terms from time to time. The updated version will be posted on this page with a revised last-updated date. Continued use of the website after updated Terms are posted means you accept the updated Terms.
